Terms of These Terms of Use govern your access to and use of the websites, online platforms, application forms, consultation forms, educational resources, courses, programs, services, communications, and other offerings made available by Nuvelle School of Nursing and Health Science and Nuvelle Inc., collectively referred to in these Terms as “Nuvelle,” “we,” “us,” or “our.”
By accessing our website, submitting a form, creating an account, purchasing a service, applying to a program, enrolling in a course, or otherwise using a Nuvelle service, you acknowledge that you have read, understood, and agreed to these Terms of Use.
Do not use our website or services if you do not agree to these Terms.
1. About Nuvelle
Nuvelle provides healthcare education, nursing education, career-training programs, nursing remediation services, refresher education, NCLEX preparation and coaching, consultation services, student resources, and related administrative support.
Nuvelle offerings may include:
Practical Nursing programs
Mental Health Technician programs
Home Health Aide training
RN remediation education
LPN remediation education
RN refresher and return-to-practice support
NCLEX preparation and coaching
Florida Board of Nursing-related educational guidance
Online learning resources
Admissions, enrollment, and student-support services
The availability, format, schedule, location, tuition, eligibility requirements, approval status, instructors, curriculum, clinical requirements, and delivery method of an offering may vary.
2. Eligibility to Use Our Services
You must be legally capable of entering into a binding agreement to use services that involve payment, enrollment, account creation, or contractual obligations.
By using our website or services, you represent that:
You are at least 18 years old or have the involvement and permission of a parent or legal guardian
The information you provide is accurate and complete
You will comply with these Terms and all applicable laws
You are not prohibited from using our services under applicable law
Certain programs may have separate age, educational, identification, background-screening, health, immunization, clinical, licensing, residency, or documentation requirements.
3. Separate Enrollment and Service Agreements
These Terms govern general use of Nuvelle websites and services.
A program application, enrollment agreement, student catalog, payment plan, refund policy, remediation agreement, consultation agreement, clinical agreement, learning-platform policy, or other written contract may contain additional terms.
When a separate written agreement applies to a specific program or service, that agreement will control regarding matters specifically addressed in it. These Terms will continue to apply to website use and matters not addressed in the separate agreement.
Submitting an application or inquiry does not create an enrollment agreement.
4. Program Applications
Submitting an application to Nuvelle does not guarantee:
Admission
Enrollment
Program eligibility
Acceptance of prior education or transfer credit
Financial assistance
Clinical placement
Licensure eligibility
Employment
A particular class schedule
A specific program start date
Nuvelle may request documentation before making an admissions or enrollment decision.
Applicants are responsible for providing accurate, complete, and current information. Nuvelle may deny, delay, cancel, or withdraw an application or enrollment decision when information is false, incomplete, misleading, unverifiable, or submitted after a required deadline.
5. Nursing Remediation, Refresher, and NCLEX Services
Nursing remediation, refresher education, consultation, and NCLEX coaching are educational services.
These services do not constitute:
Legal advice
Legal representation
Representation before the Florida Board of Nursing
A promise that a regulatory requirement has been satisfied
A guarantee of authorization to test
A guarantee of license issuance, renewal, or reinstatement
A guarantee of passing the NCLEX or another examination
A guarantee of employment or return to practice
You are responsible for reviewing and complying with requirements issued by the applicable nursing board, licensing agency, testing organization, employer, educational institution, or other authority.
Nuvelle may help you understand educational options and next steps, but government agencies, licensing boards, testing organizations, and other third parties make their own independent decisions.
6. No Guarantee of Educational, Licensing, or Employment Outcomes
Nuvelle does not guarantee that participation in a program, course, consultation, remediation service, refresher service, or coaching service will result in:
Graduation
Course completion
Licensure
Certification
Regulatory approval
Examination eligibility
A passing examination score
Clinical placement
Employment
Promotion
Increased compensation
Acceptance by another school or employer
Results depend on many factors, including attendance, academic performance, skills, documentation, regulatory requirements, testing performance, background requirements, clinical availability, employer decisions, and individual effort.
Testimonials and student experiences describe individual results and do not guarantee that another person will receive the same outcome.
7. Program and Regulatory Information
Nuvelle works to provide accurate and current information. Educational, regulatory, licensing, examination, and program requirements may change.
You should not rely solely on a website page, social media post, advertisement, email, consultation, or informal conversation when making a licensing or regulatory decision.
Current written requirements from the applicable government agency, licensing board, testing organization, program catalog, enrollment agreement, or official Nuvelle notice will control.
References to approval, authorization, alignment, eligibility, or compliance apply only to the specific program, service, time period, and regulatory context identified in the applicable written materials.
8. Tuition, Fees, and Payments
Tuition, fees, deposits, payment schedules, financing arrangements, promotional offers, and refund terms may vary by program or service.
You agree to:
Pay all charges you authorize
Provide accurate billing information
Review the applicable payment and refund terms before submitting payment
Notify Nuvelle promptly of a billing concern
Comply with any payment plan or enrollment agreement you accept
Unless otherwise stated in writing, submitting a payment does not override admissions, eligibility, documentation, attendance, or academic requirements.
Promotional offers may have eligibility rules, expiration dates, exclusions, and other conditions. Promotions cannot be combined unless expressly stated.
9. Cancellations and Refunds
Cancellations, withdrawals, refunds, credits, and transfers are governed by the written policy applicable to the program or service purchased.
Depending on the offering, the applicable policy may appear in:
An enrollment agreement
A school catalog
A payment agreement
A checkout page
A service agreement
A written refund or cancellation policy
You are responsible for reviewing the applicable policy before enrolling or making a payment.
Nothing in these Terms limits any nonwaivable consumer right available under applicable law.
10. Online Accounts and Learning Platforms
Some Nuvelle services may require access to a learning-management system, student portal, video-conferencing platform, payment portal, or other account.
You are responsible for:
Maintaining the confidentiality of your login information
Using your account only for authorized purposes
Not sharing course access with another person
Promptly notifying Nuvelle of suspected unauthorized access
Using supported devices, software, and internet access
Submitting assignments and completing activities by applicable deadlines
You may not sell, transfer, lend, publish, or share your account credentials.
Nuvelle may suspend or terminate account access when it reasonably believes an account is being misused, shared, compromised, or used in violation of these Terms.
11. Electronic Communications and Signatures
By submitting an online form, clicking an acceptance box, creating an account, making a payment, or electronically signing a document, you consent to conducting the applicable transaction electronically.
You agree that electronic communications may include:
Application notices
Enrollment information
Payment notices
Course announcements
Schedule updates
Consultation follow-up
Student-support communications
Required disclosures
Policies and agreements
You are responsible for providing a current email address and telephone number.
You may request a paper copy of an electronically provided agreement by contacting Nuvelle. Additional administrative or delivery charges may apply when permitted by law and disclosed in advance.
12. Telephone, Email, and Text Communications
When you provide contact information, you authorize Nuvelle to contact you regarding your application, inquiry, enrollment, account, payment, consultation, program, or requested service.
Communications may be sent by telephone, email, or text message using the contact information you provide.
Consent to receive promotional communications is not a condition of enrollment or purchase.
You may opt out of promotional email or text communications by following the instructions included in the message. Opting out of promotional communications does not prevent Nuvelle from sending administrative, transactional, safety, academic, or account-related communications.

13. Acceptable Use
You may use Nuvelle websites and services only for lawful educational, informational, administrative, and personal purposes.
You may not:
Provide false or misleading information
Impersonate another person
Access another person’s account
Share paid course materials without permission
Copy, record, distribute, sell, or publish protected course content
Attempt to bypass access controls
Introduce malware, malicious code, or harmful files
Scrape or extract data through automated means without permission
Disrupt a website, platform, class, meeting, or service
Harass, threaten, discriminate against, or abuse students, employees, instructors, or other users
Use Nuvelle content to create a competing course or commercial product
Submit unlawful, infringing, defamatory, or fraudulent material
Use artificial intelligence or automated tools in a manner prohibited by an academic-integrity policy
Misrepresent academic work as your own
Use the website or services in violation of applicable law
Nuvelle may investigate suspected violations and take appropriate action.
14. Academic Integrity and Professional Conduct
Students and participants must comply with applicable academic-integrity, attendance, conduct, clinical, testing, and professionalism policies.
Prohibited conduct may include:
Cheating
Plagiarism
Unauthorized collaboration
Falsification of records
Misuse of artificial intelligence
Sharing examination content
Recording classes without authorization
Disruptive or threatening behavior
Misrepresentation of clinical or educational activities
Violations of patient, student, or employee privacy
Consequences may include warnings, assignment penalties, removal from an activity, suspension, dismissal, loss of platform access, or referral to the appropriate authority, subject to applicable policies and agreements.
15. User-Submitted Information
You may submit applications, documents, messages, assignments, feedback, reviews, testimonials, photographs, or other information to Nuvelle.
You represent that:
The information is accurate
You have the right to submit it
It does not violate another person’s rights
It does not contain unlawful or malicious material
You have obtained any required permission before submitting information about another person
You retain ownership of original content you submit, except for rights granted in a separate agreement.
You grant Nuvelle a limited right to receive, store, review, process, reproduce, and use submitted information as reasonably necessary to provide services, administer programs, maintain records, comply with law, protect safety, and enforce agreements.
Nuvelle will not use a student’s name, photograph, testimonial, or likeness for public marketing without the authorization required by applicable law and policy.
16. Sensitive Information
Do not submit sensitive information through a general contact form unless Nuvelle specifically requests it through an approved method.
Sensitive information may include:
Social Security numbers
Government identification numbers
Full financial account details
Passwords
Detailed medical information
Patient information
Protected health information
Unredacted regulatory or legal documents
Criminal-history documentation
Nuvelle may provide a secure or alternative method for transmitting sensitive documents.
17. Privacy and Student Records
Nuvelle’s collection and use of personal information are also governed by its Privacy Policy and applicable student-record policies.
Where the Family Educational Rights and Privacy Act or another student-record law applies to a particular Nuvelle entity, program, or record, Nuvelle will handle the applicable record in accordance with governing law and institutional policy.
Not every inquiry, website submission, applicant record, or commercial training record is necessarily governed by FERPA.
Users are responsible for reviewing the Privacy Policy and any student-record notice applicable to their program.

Nuvelle websites and educational materials may contain content owned by or licensed to Nuvelle, including:

Videos
Presentations
Graphics
Images
Assessments
Study guides
Worksheets
Software
Branding
Logos
Website layouts
Databases
Downloadable resources
This content is protected by intellectual-property laws.
Nuvelle grants you a limited, personal, nonexclusive, nontransferable, revocable license to access authorized content for your own educational or informational use.
You may not reproduce, distribute, publicly display, sell, sublicense, modify, create derivative works from, or commercially exploit Nuvelle content without prior written permission.
19. Course Recordings and Virtual Sessions
Nuvelle may record certain classes, orientations, consultations, or virtual sessions when permitted by applicable law and policy.
When recording occurs, Nuvelle will provide notice or obtain consent when required.
You may not independently record, photograph, livestream, transcribe, or distribute a class, consultation, clinical discussion, student interaction, or virtual session without prior authorization.
20. Third-Party Services and Links
Nuvelle may use or link to third-party services, including learning platforms, payment processors, scheduling systems, video-conferencing providers, testing services, social-media platforms, and external websites.
Third-party services are governed by their own terms and privacy practices.
Nuvelle does not control and is not responsible for:
Third-party content
Third-party availability
External security practices
External privacy practices
Third-party fees
Changes made by outside providers
Decisions made by licensing boards, testing organizations, employers, or other institutions
A link or reference does not necessarily mean Nuvelle endorses every statement, product, or service provided by the third party.
21. Website Availability and Changes
Nuvelle may update, modify, suspend, restrict, or discontinue any part of a website or online service.
Nuvelle does not guarantee that:
A website will always be available
A platform will operate without interruption
Content will be error-free
Every device or browser will be supported
Stored content will never be lost
Third-party systems will remain available
Nuvelle may perform maintenance, security updates, platform migrations, or other changes without prior notice when reasonably necessary.
22. Disclaimer of Warranties
To the fullest extent permitted by law, Nuvelle websites, online content, and general informational services are provided on an “as is” and “as available” basis.
Nuvelle disclaims warranties that are not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
This disclaimer does not eliminate warranties or rights that cannot legally be waived.
23. Limitation of Liability
To the fullest extent permitted by law, Nuvelle and its owners, officers, directors, employees, instructors, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use, platform interruption, loss of data, reliance on general information, third-party conduct, or unauthorized account access.
When liability cannot be excluded, Nuvelle’s aggregate liability arising from a website or service will not exceed the amount you paid Nuvelle for the specific service giving rise to the claim during the six months preceding the event, unless a different limitation is required by applicable law or stated in a separate written agreement.
This section does not limit liability that cannot legally be limited.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Nuvelle and its owners, officers, directors, employees, instructors, contractors, and affiliates from claims, losses, liabilities, damages, judgments, and reasonable expenses arising from:
Your violation of these Terms
Your unlawful use of a website or service
Information or content you submit
Your infringement of another person’s rights
Your misuse of an account or educational resource
This obligation does not apply to claims caused solely by Nuvelle’s conduct where indemnification is prohibited by law.
25. Suspension and Termination
Nuvelle may suspend, restrict, or terminate access to a website, account, platform, program, or service when reasonably necessary to:
Protect students or staff
Prevent fraud or security threats
Address nonpayment
Enforce academic or conduct policies
Respond to misuse of course materials
Comply with law or regulatory direction
Investigate suspected violations
Protect Nuvelle systems and intellectual property
Program dismissal, withdrawal, or termination may also be governed by a catalog, enrollment agreement, student handbook, or other applicable policy.
26. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless another written agreement requires a different forum, any legal action arising from these Terms or use of Nuvelle websites or services must be brought in a state or federal court with jurisdiction in Broward County, Florida.
You and Nuvelle consent to the personal jurisdiction of those courts.
27. Informal Resolution of Disputes
Before filing a legal action, you agree to provide Nuvelle with written notice describing the dispute and the requested resolution.

The parties agree to make a good-faith effort to resolve the dispute informally before beginning litigation, unless immediate legal action is reasonably necessary to protect safety, confidentiality, intellectual property, or another legal right.
28. Changes to These Terms
Nuvelle may update these Terms to reflect changes in services, technologies, policies, or legal requirements.
The updated version will be posted with a revised “Last Updated” date.
When required, Nuvelle may provide additional notice by email, account notification, website banner, or another reasonable method.
Your continued use of the website or services after an updated version becomes effective constitutes acceptance of the updated Terms, except where additional consent is required by law or contract.
29. Severability
If a court determines that part of these Terms is invalid or unenforceable, the remaining provisions will remain in effect.
The invalid provision will be enforced to the greatest extent permitted by law or modified as necessary to make it enforceable.
30. No Waiver
A failure by Nuvelle to enforce a provision of these Terms does not waive the right to enforce that provision later.
A waiver must be in writing and signed by an authorized Nuvelle representative.
31. Assignment
You may not transfer or assign your rights or obligations under these Terms without Nuvelle’s prior written consent.
Nuvelle may assign these Terms as part of a merger, reorganization, sale, transfer of assets, change in ownership, or transfer to an affiliated entity, subject to applicable law.
32. Force Majeure
Nuvelle will not be responsible for delays or failures caused by events reasonably beyond its control, including severe weather, natural disasters, public-health emergencies, utility failures, internet outages, cyberattacks, governmental actions, labor disruptions, facility closures, clinical-site disruptions, testing-provider interruptions, or failures of third-party platforms.
Nuvelle will make reasonable efforts to communicate material changes and provide an appropriate alternative when feasible.
33. Entire Agreement
These Terms, together with the Privacy Policy and any applicable enrollment agreement, catalog, payment agreement, refund policy, student handbook, or service agreement, form the agreement governing your use of Nuvelle websites and services.
These Terms replace prior discussions or statements concerning general website use but do not replace a separately signed program or service agreement.
